Conclusion of a contract

1. Information on the Goods provided on the Shop’s website, in particular their descriptions, technical and performance parameters, as well as prices constitute an invitation to conclude a contract in the meaning of Art. 71 of the Civil Code.

  • By confirming an Order, the Customer makes a declaration of intent to enter into a contract of sale with Euroflorist subject to the Terms and Conditions.
  • After placing an order, the Customer will receive an email message entitled “Order confirmation”, which will include all necessary details of the Order. This email message constitutes a confirmation only of the receipt of the order by Euroflorist, and should not be understood as a declaration of intent.
  • The Contract is deemed concluded when the Customer receives the second email message entitled “Order confirmation” with a final confirmation of all order details. This email message constitutes a declaration of intent by Euroflorist to enter into a contract of sale

2. Every Customer of Euroflorist’s online shop who is a consumer in the meaning of Art. 221 of the Civil Code is entitled, pursuant to the provisions of the applicable law, to withdraw from the contract of sale of goods (or services) without giving any reason, within the period specified below. A statement of withdrawal from the contract should be delivered to the address: Euroflorist Sp. z o.o. ul. Sowińskiego 18A, 60-283 Poznań, with a note: “Withdrawal from contract” or via email at: [email protected]

3. The consumer has the right to withdraw from the contract within 14 days, calculated from the date of receipt of the goods or the date of conclusion of the contract for the provision of services. The withdrawal shall be deemed timely if the consumer sends the statement of withdrawal at the above indicated address before the lapse of the above indicated period.

4. For distance contracts, withdrawal means the contract is deemed null and void. Whatever the parties have furnished shall be returned unchanged, save when the change was necessary in the ordinary course of administration. The return shall take place immediately, no later than within 14 days. The goods shall be returned to the address: Euroflorist Sp. z o.o. ul. Sowińskiego 18A, 60-283 Poznań.

5. The consumer shall bear the costs of return of goods, unless the withdrawal results from incapability, even temporary, of Euroflorist Sp. z o.o. to provide service as ordered by the consume

6. Pursuant to Art. 10 Sec. 3 of the Act on the Protection of Certain Consumer Rights, the right of withdrawal from the distance contract shall not be vested in the consumer in the following cases:

  • if performance of services by Euroflorist started, with the consumer’s consent, before the end of the period of 14 days of concluding the contract;
  • the goods (and services) exceed the standard offer of the shop, with characteristics specified by the consumer, adjusted to the consumer’s needs;
  • performance which by reason of its nature cannot be returned or the subject of which is susceptible to quick deterioration.

In connection with the above, in the online flower delivery service TwojeKwiaty.pl, the right of withdrawal from the contract does not apply for goods such as bouquets and flower arrangements.
